We present the following text because it is required of us by the law and legal regulations of the Czech Republic and the EU.
In accordance with the legal regulations of the European Union, the administrator hereby states that in relation to Regulation (EU) 2023/1114 of the European Parliament and of the Council of 31 May 2023 on crypto-asset markets (hereinafter referred to as "MiCA"), it applies the regime according to Article 2, paragraph 3 of this regulation.
In accordance with legal regulations, the administrator hereby states that he is a registered person pursuant to § 15 of Act No. 240/2013 Coll., on investment companies and investment funds (hereinafter referred to as "ZISIF"), and is therefore subject to legal regulation in accordance with the Directive of the European Parliament and Council 2011/61/EU of 8 June 2011 on alternative investment fund managers and amending Directives 2003/41/EC and 2009/65/EC and Regulation (EC) No. 1060/2009 and (EU) No. 1095/2010 (AIFMD), MiCA regulation and § 15 ZISIF. With this in mind, the Cryptocurrency Fund is registered on the list maintained by the Czech National Bank, but is not subject to its supervision.
In accordance with legal regulations, the administrator hereby states that he is an obligated person according to § 2 paragraph 1 letter b) point 4 of Act No. 253/2008 Coll., on certain measures against the legalization of proceeds from criminal activities and the financing of terrorism, as amended, and according to this Act, among other things, he is obliged to implement measures according to this Act and other regulations, among others perform client identification and control. For this purpose, he is obliged to collect and store the client's personal data and make copies of the documents from which he verified this data.
